1. Acceptance of Terms

By accessing or using the Bright Side Messaging app ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, then you may not access the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

2. User Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. Specifically, you agree not to:

  • Harass, abuse, or harm another person or group.
  • Transmit any content that is obscene, offensive, or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
  • Use the Service for any fraudulent or unlawful purpose.
  • Disrupt the normal flow of dialogue or act in a manner that negatively affects other users' ability to engage in real-time exchanges.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

3. Content Restrictions

You are solely responsible for all content, whether publicly posted or privately transmitted, that you upload, post, email, transmit, or otherwise make available via the Service. We reserve the right, but are not obligated, to review and remove any content that violates these Terms, is illegal, or is otherwise objectionable in our sole discretion.

4. Account Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

5. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Bright Side Messaging does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location; or that any errors or defects will be corrected.

6. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Bright Side Messaging is operated, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
